Terms of Service

These terms govern your use of the Subtrackt app and the subtrackt.io website. By using either, you agree to them. Subtrackt is operated by Subtrackt.io, LLC, a California limited liability company.

What Subtrackt is

Subtrackt is an AI-enabled podcast player. The Subtrackt client app accesses publicly available podcast feeds and episodes. During access, AI will identify segments and topics within the podcast enabling you to navigate through, and optionally skip over, content segments.

Accessed podcast feeds and episodes belong to their creators and publishers. Subtrackt does not publish, redistribute, or alter source podcasts — episodes are fetched from each publisher’s own feed, and any copy we keep exists only to analyse the episode for you. Your use of any podcast remains subject to that publisher’s terms.

Your Account

The Subtrackt app requires the use of an account. Keep your sign-in method secure; you’re responsible for activity under your account. One account covers one person’s personal, non-commercial use on up to five devices.

Early Software

Subtrackt is new, and it is still being built. Segments can be mislabeled, an ad may slip through, and features may change or disappear between releases. Feedback and diagnostic reports you choose to send may be used to improve the product. We mention this plainly because you are paying for it, and you should know what you are buying into.

Subscriptions and Billing

Subtrackt offers Free and Premium plans. Free covers two selected shows already in our catalog, with unlimited listening and no expiry. Each selection can be replaced once every seven days, independently of the other. Your first two selections do not count as replacements. Removing a show does not free its slot or reset its change date; you can re-add the show still assigned to that slot anytime. Only a successful replacement starts its seven-day wait. Older episodes that have not been prepared may require Premium.

Free can be active for one account per recognized phone. You explicitly choose that account; signing in alone does not assign Free. The first assignment starts a seven-day wait before transferring Free to another account, and each successful transfer starts the wait again. Cancelling or a refused transfer leaves the current assignment intact. Other accounts can still sign in, browse, and purchase or restore Premium. Your two show selections and their replacement dates stay with your account, including when you use another phone. Paid, comped, grace-period and remaining preview access take precedence without resetting the phone assignment.

Free offline access to your last verified selections lasts up to seven days after the app connects successfully. Reconnect to refresh access; the Free plan itself does not expire. A selection changed on another device is updated when this device reconnects. A fresh sign-in requires an online Free check; switching away and back does not restore an earlier offline allowance. Unconfirmed account transfers also require an online check.

Premium supports unlimited followed shows, subject to the processing allowances described in the app and on our pricing page. Prices and renewal terms are shown before purchase. Any existing free preview runs through its granted end date, then becomes Free; a paid subscription returns to Free when paid access ends. Your library and listening history remain, and you choose which two shows Free covers.

On Android, subscriptions are sold and billed through Google Play. Billing recurs at the interval shown at purchase until you cancel, and you cancel through your Google Play account rather than through us. When you cancel, your subscription stays active until the end of the period you have already paid for, and it does not renew after that.

Refunds are handled by Google Play under Google’s refund policy. We do not process payments, so we cannot issue a refund directly — but if something has gone wrong, write to us at [email protected] and we will help where we can, including supporting a refund request to Google.

If we terminate your account for a reason other than a breach of these terms, contact us and we will work with you and with Google Play on the unused portion of your subscription.

Acceptable Use

Don’t abuse this service. Unacceptable use includes, but is not limited to: attempts to break, overload, reverse engineer, or misuse the App or API; using Subtrackt to redistribute podcast content; automated scraping of our services; anything unlawful.

Intellectual Property

Subtrackt’s software, branding, and AI-generated podcast metadata are ours. The podcasts are their publishers’. Nothing in these terms transfers ownership of either to anyone.

If you believe content available through Subtrackt infringes your copyright, our notice-and-takedown process — including where to send a notice and what it must contain — is on our copyright page. You can also report a copyright concern from inside the app, from any show or episode.

Disclaimers

Subtrackt is provided “as is” without warranties of any kind, express or implied — including fitness for a particular purpose and uninterrupted availability. AI segmentation is probabilistic: we don’t guarantee any results or warrant any quality within the segmentation of episodes.

Not all shows or episodes may be available for access or AI segmentation within the Subtrackt platform.

Limitation of Liability

To the maximum extent permitted by law, Subtrackt’s total liability for any claim arising from these terms or the service is limited to the amount you paid us in the twelve months before the claim. You agree that Subtrackt is not liable for indirect, incidental, or consequential damages.

Termination

You can stop using Subtrackt at any time. You may delete your account by following this account deletion process. We reserve the right to suspend or terminate accounts that violate these terms, and to suspend or terminate accounts for any lawful reason.

Governing Law

These terms are governed by the laws and jurisdiction of the proud state of California, and broadly, of the United States of America. San Diego County, California is agreed as the venue for legal actions and arbitration relating to the Subtrackt app, website, and service.

Changes

We may update these terms. Material changes will be registered with a preamble on this page, noting dates and a summary. An in-app notification will also appear to users for material updates to these terms. Continued use of the Subtrackt app and website after notification of changes means acceptance of those changes.
