Subtrackt respects copyright. This page explains how to tell us about material you believe infringes your rights, what happens next, and how to respond if your material was removed in error.

Subtrackt is operated by Subtrackt.io, LLC, a California limited liability company.

What Subtrackt does with podcasts

Subtrackt is a podcast player. It fetches episodes from each publisher’s own public feed and analyses them so listeners can navigate and skip segments. Subtrackt does not publish or redistribute podcasts, and it does not accept uploads of user content.

How to send a copyright notice

Email [email protected] with the subject line “Copyright notice”. You can also report a copyright concern from inside the Subtrackt app, from any show or episode.

Under 17 U.S.C. § 512(c)(3), a notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed. If several works are covered by one notice, a representative list is fine.
  3. Identification of the material you claim is infringing, with enough detail for us to find it — for a podcast, that means the show name and, where relevant, the specific episode.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on their behalf.

A notice missing these elements may not be legally effective, and we may not be able to act on it. If you are unsure whether the use you are reporting is authorized, please consider seeking legal advice first — misrepresenting infringement can carry liability under § 512(f).

Designated agent

Subtrackt.io, LLC has a designated agent registered with the U.S. Copyright Office. Notices may be sent to that agent:

The registration can be verified in the Copyright Office’s public Designated Agent Directory.

What happens next

We review copyright notices promptly. Where a notice is valid and complete, we act expeditiously to remove or disable access to the material identified, and we make a reasonable effort to notify the affected publisher.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address. Under § 512(g)(3) it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for your address — or, if you are outside the United States, for any district in which we may be found — and that you will accept service of process from the party who filed the original notice.

We will forward a valid counter-notice to the original complainant. Unless they file a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.

Repeat infringement

Subtrackt has no mechanism for a listener to publish or share content, so infringement here does not arise from anything a listener uploads — it arises from published podcast feeds. Our policy therefore applies where it can actually apply: we stop processing, and remove from the service, feeds and publishers that are the subject of repeated valid notices. In the appropriate circumstances contemplated by 17 U.S.C. § 512(i), that extends to terminating an account used to repeatedly introduce infringing material.
