Terms of Service

These terms govern your use of the Subtrackt app and the subtrackt.io website. By using either, you agree to them. Subtrackt is operated by Subtrackt.io, LLC, a California limited liability company.
What Subtrackt is
Subtrackt is an AI-enabled podcast player. The Subtrackt client app accesses publicly available podcast feeds and episodes. During access, AI will identify segments and topics within the podcast enabling you to navigate through, and optionally skip over, content segments. Accessed podcast feeds and episodes belong to their creators and publishers; Subtrackt does not host, own, or modify source podcasts in any way. Your use of any podcast remains subject to that publisher’s terms.
Your Account
The Subtrackt app requires the use of an account. Keep your sign-in method secure; you’re responsible for activity under your account. One account covers one person’s personal, non-commercial use on up to five devices.
Beta Software
While Subtrackt is in beta: it’s provided free, as-is, and things will occasionally break. Segments can be mislabeled, an ad may slip through, a feature may change or disappear. Beta feedback and diagnostic reports you choose to send may be used to improve the product.
Subscriptions and Billing
Pricing for paid subscriptions will be shown before you pay, billing will recur until you cancel, and you can cancel anytime for a pro-rated refund of the current billing period. These terms will be updated with additional specific details (including refund handling and app-store billing requirements) before the Subtrackt app exits private beta.
Acceptable Use
Don’t abuse this service. Unacceptable use includes, but is not limited to: attempts to break, overload, reverse engineer, or misuse the App or API; using Subtrackt to redistribute podcast content; automated scraping of our services; anything unlawful.
Intellectual Property
Subtrackt’s software, branding, and AI-generated podcast metadata are ours. The podcasts are their publishers’. Nothing in these terms transfers ownership of either to anyone.

Disclaimers
Subtrackt is provided “as is” without warranties of any kind, express or implied — including fitness for a particular purpose and uninterrupted availability. AI segmentation is probabilistic: we don’t guarantee any results or warrant any quality within the segmentation of episodes.
Not all shows or episodes may be available for access or AI segmentation within the Subtrackt platform.
Limitation of Liability
To the maximum extent permitted by law, Subtrackt’s total liability for any claim arising from these terms or the service is limited to the amount you paid us in the twelve months before the claim — which, during the free beta, is zero. You agree that Subtrackt is not liable for indirect, incidental, or consequential damages.
Termination
You can stop using Subtrackt at any time. You may delete your account by following this account deletion process. We reserve the right to suspend or terminate accounts that violate these terms, and to suspend or terminate accounts for any lawful reason. Pro-rated refunds will be provided for paid future time in the event of an account termination by Subtrackt.
Governing Law
These terms are governed by the laws and jurisdiction of the proud state of California, and broadly, of the United States of America. San Diego County, California is agreed as the venue for legal actions and arbitration relating to the Subtrackt app, website, and service.
Changes
We may update these terms. Material changes will be registered with a preamble on this page, noting dates and a summary. An in-app notification will also appear to users for material updates to terms after the application exits its free closed beta stage. Continued use of the Subtrackt app and website after notification of changes means acceptance of those changes.
